A 20-year-old Colorado Springs man will stand trial on a murder charge despite his attorney's protests that he wasn't present when the victim was killed.

A district court judge on Wednesday ruled there is sufficient evidence for Robert Anthony Rodriquez to be tried on first-degree murder, aggravated robbery and conspiracy to commit robbery in the Oct. 22 shooting death of John Henry Smith, 19, of Widefield.
